In order to be considered the winner of a presidential election, according to Michael Aondoakaa (SAN), a former attorney general and minister of justice in Nigeria, a candidate must receive 25% of the votes cast in at least two-thirds of the 36 states and Abuja’s federal capital territory (FCT).

According to Aondoakaa, the 2008 Supreme Court decision that indicated the present requirement to win an election is still in place today. He added that the Constitution is explicit when describing the requirements for being elected and that they have not altered since 1999.

When there are more than two candidates for a position, he said: “A candidate for this office is considered to be duly elected if he has the highest number of votes cast in the election, and if he has not less than one-fourth of the votes, cast in elections in each of not less than two-thirds of all the states of the federation and the federal capital territory, Abuja.

 

 

Due to the fact that Bola Ahmed Tinubu did not receive the minimum 25% of the vote in the Federal Capital Territory (FCT), he wasn’t entitled to be elected president. This is due to the fact that INEC, the electoral commission, mistakenly gave him the president.
